The feature article of the special patent reform edition of the Medical Innovation & Business journal is by venture capitalist Gary Lauder. The author expresses his concern that proposed legislative patent reform could spell the end of venture capital funding for innovative start-ups in America. Lauder focuses on three aspects in particular of the proposed reforms: weakening the filing grace period, expanding post-grand opposition and apportionment of damages. He asserts that the main provisions of proposed reforms are universally adverse to small companies and consequently, to venture capital. Lauder goes on to say that the U.S. has the most innovative economy in the world, yet the patent reform bill threatens to materially harm it to solve "problems" with the patent system that are not really problems at all.
